  • Right to Opt Out of Sale: You have the right to opt out or ask us not to sell your Personal Information. Please note that We do not sell your Personal Information in exchange for money. We do use and share your information in order to provide our services. However, the CCPA broadly defines the concept of “selling” information and disclosures to third parties we partner with are inherent in providing our services. Such disclosures may constitute a “sale” for CCPA purposes. You may opt out of the “sale” of your information; however, doing so will prevent our ability to provide our services to you by matching you to a clinical trial. Therefore, if you elect to opt out of the “sale” if your Personal Information, we will need to delete your information.   • Right to Non-Discrimination: You have the right not to receive discriminatory treatment by us for exercising any of your rights under the CCPA. You can exercise these rights yourself or you can designate an authorized agent to make a request on your behalf. Your authorized agent must be able to demonstrate authority to act on your behalf as further instructed when submitting a verifiable request on your behalf. How Do I Opt Out?

You may choose not to be contacted by Clinical Media by following the "unsubscribe" instructions in the specific email from which you wish to opt-out or emailing privacy@clinicalmedia.com, specifying the particular communications from which you wish to be removed.

To opt out of receiving marketing communications via SMS, respond to the text message that you have received with “Stop”, “Quit”, or “End”.

In addition, under “California’s Shine the Light” law, California residents may opt out of allowing Clinical Media to: (a) share personally identifiable information with Clinical Media affiliates for their direct marketing purposes; and (b) share personally identifiable information with third party companies for their marketing purposes. You may indicate your preferences to opt out of any combination of the choices above by emailing privacy@clinicalmedia.com. Please specify in your email from which choice you are opting out:

  • Receiving communications from Clinical Media;

  • Allowing Clinical Media to share your personal information with Clinical Media affiliates for their marketing purposes; and/or

  • Allowing Clinical Media to share your personal information with third-party companies for their marketing purposes.

Meta Marketing API and Meta Business Tools

Overview. Clinical Media integrates with Meta Platforms, Inc. ("Meta") business tools, including the Meta Marketing API, Meta Conversions API, and Meta Pixel, to help healthcare advertisers manage campaigns across Facebook, Instagram, and other Meta-owned properties. This section describes how data is collected, shared, and used in connection with these Meta integrations.

How Clinical Media Uses Meta Business Tools. Clinical Media uses Meta's platform in the following ways:

  • Meta Marketing API. Advertisers may connect their Meta ad accounts to Clinical Media. When an advertiser authorizes this connection, Clinical Media reads campaign structure, ad creative details, and performance data (such as impressions, clicks, and spend) from Meta to display within the Clinical Media dashboard.

  • Meta Conversions API. Clinical Media may transmit conversion event data to Meta on behalf of advertisers so they can measure the effectiveness of their Facebook and Instagram advertising campaigns.

  • Meta Pixel and Similar Technologies. Clinical Media may deploy the Meta Pixel or similar tracking technologies on websites we operate (such as carehealthsource.com). The Meta Pixel is a snippet of code that collects data about visitor activity on our sites and sends it to Meta to support ad measurement, optimization, and audience building.

Data Categories Shared with Meta. When you interact with a Clinical Media-operated website or submit information through one of our forms, the following categories of data may be shared with Meta:

  • Hashed personal identifiers — email address and phone number, transmitted in hashed (pseudonymized) form using SHA-256 hashing before being sent to Meta

  • Device and browser information — IP address, browser type and version, operating system, screen resolution, and device identifiers

  • Conversion events — actions taken on our sites, such as form submissions, page views, ad clicks, and linkout events

  • Ad interaction data — information about which ads were viewed or clicked, including Meta click identifiers (fbclid) and related attribution data

Clinical Media does not share names, dates of birth, mailing addresses, health conditions, treatment information, or other health-related information with Meta through these integrations. Clinical Media's use of Meta Business Tools in the healthcare advertising context is structured to avoid transmission of Protected Health Information (PHI) or sensitive health data.

Purpose of Data Sharing. Clinical Media shares data with Meta for the following purposes:

  • Ad measurement and attribution — determining whether ads shown on Meta's platforms led to actions on Clinical Media-operated websites

  • Campaign optimization — enabling Meta's algorithms to improve ad delivery for advertisers using the Clinical Media platform

  • Audience building and targeting — allowing advertisers to build Custom Audiences and Lookalike Audiences based on conversion data

  • Reporting — providing advertisers with performance metrics for their Meta advertising campaigns

User Consent. Clinical Media obtains consent for Meta-related data collection and sharing in the following ways:

  • When you visit a Clinical Media-operated website, you may be presented with a consent interface that discloses the use of third-party tracking technologies, including Meta Pixel. Meta-related tracking technologies are activated in accordance with your cookie preferences as indicated through our consent interface.

  • When you submit a form on one of our websites, the applicable terms and privacy disclosures presented at the point of submission describe how your information may be shared with third-party advertising partners, including Meta.

  • Advertisers who connect their Meta ad accounts to Clinical Media authorize the data exchange through Meta's own OAuth permissions flow, which describes the data access being granted.

Data Retention. Clinical Media retains data associated with Meta integrations for as long as necessary to fulfill the purposes described above, and in accordance with the retention periods set forth elsewhere in this Privacy Policy. Specifically:

  • Conversion event data sent to Meta via the Conversions API is retained by Clinical Media for up to 25 months from the date of collection, unless a shorter period is required by law.

  • Meta Pixel data collected on our websites is subject to Meta's own retention policies once transmitted to Meta. On our systems, associated log data is retained for up to 25 months.

  • Hashed identifiers used for audience matching are retained only for the duration of the relevant advertising campaign or audience, after which they are deleted from our systems.

Meta's own retention of data received through these tools is governed by Meta's data policies.

Your Rights and Opt-Out Options. You have several options for limiting or stopping the collection and sharing of your data through Meta Business Tools:

  • Opt out of Meta Pixel tracking. You can disable cookies and tracking technologies through your browser settings or through the cookie consent controls on our websites. You may also use browser extensions designed to block tracking scripts, such as uBlock Origin or Privacy Badger, along with general ad-blocking tools.

  • Manage your Meta ad preferences. You can control how Meta uses data for advertising by visiting your Meta Ad Preferences at https://www.facebook.com/adpreferences.

  • Industry opt-out tools. You may opt out of interest-based advertising from Meta and other participating companies by visiting the Digital Advertising Alliance at https://optout.aboutads.info or the Network Advertising Initiative at https://optout.networkadvertising.org.

  • Do Not Track. Some browsers offer a "Do Not Track" signal. While there is no uniform standard for how websites must respond to this signal, Clinical Media respects browser-level cookie and tracking preferences where technically feasible.

Please note that opting out of Meta tracking does not prevent you from seeing ads; it limits the ability to personalize ads based on your activity on Clinical Media-operated websites.

Data Deletion. You have the right to request deletion of personal data that Clinical Media has collected about you and shared with Meta in connection with our advertising and measurement activities. To submit a data deletion request:

  1. Contact Clinical Media directly. Send an email to privacy@clinicalmedia.com or call us at (512) 368-8438 with the subject line "Meta Data Deletion Request." Please include your name and the email address associated with your interaction so we can locate your records.

  2. What happens next. Upon receiving a verified deletion request, Clinical Media will (a) delete or de-identify the relevant data from our own systems within 45 days of a verified request (with a possible extension of an additional 45 days where reasonably necessary), in accordance with applicable law, and (b) notify Meta to delete the corresponding data received through our integrations, in accordance with Meta's data deletion protocols.

  3. Meta's deletion process. Data that has already been transmitted to Meta is also subject to Meta's own deletion procedures. You may submit a deletion request directly to Meta through your Facebook account settings or by visiting https://www.facebook.com/help/contact/deletion.

Clinical Media supports data deletion requests in accordance with Meta's platform policies. If you submit a deletion request, we will process it as described above.

Meta's Privacy Policy. Meta's collection, use, and sharing of data received through Meta Business Tools is governed by Meta's own privacy policy, which is available at https://www.facebook.com/privacy/policy/. When Clinical Media shares data with Meta through these tools, Meta acts as an independent data controller and processes that data in accordance with its own privacy policy and terms. Clinical Media does not control Meta's data practices or retention decisions. Clinical Media encourages you to review Meta's privacy policy to understand how Meta handles your data independently of Clinical Media.

Disputes

All disputes, controversies and claims from or relating to this privacy policy, including any subsequent updates, shall be submitted to arbitration before the American Arbitration Association (“AAA”) in accordance with the AAA Commercial Arbitration Rules. The place of arbitration shall be Austin, Texas and the proceedings shall be English. The arbitrator may award any form of individual or equitable and injunctive relief. Any award will be final and conclusive to the parties and may be entered in any court of competent jurisdiction. The parties may also plead to any court of competent jurisdiction for a temporary restraining order, preliminary injunction, or other interim relief, without breach of this paragraph and without reducing the scope of the powers of the arbitrator. You agree to the entry of injunctive relief to stop any lawsuit or to remove you as a participant in such a suit. By agreeing to this provision, you waive your right to bring, join, or participate in a class action lawsuit related to this privacy policy; however, you do not waive your rights or remedies to pursue an individual claim in binding arbitration. The preceding provision is an independent covenant, which you may opt out of by providing written notice of your decision within thirty (30) days of the date that you first use the Clinical Media website.
